Terms of the restonim.com website and the RESTONIM waiting list
Version of 17 October 2026
This is a translation of the Polish Terms; the Polish version is binding.
§ 1. General provisions
- These Terms set out the rules for using the website restonim.com (the “Website”) and the rules for the electronic provision of the RESTONIM waiting-list service (the “Waiting list”).
- The service provider is Jarosław Olejarz, conducting business activity under the business name KANCELARIA RADCY PRAWNEGO JAROSŁAW OLEJARZ, with the address ul. Marii Skłodowskiej-Curie 44/3, 40-057 Katowice, Poland, NIP (tax identification number): 6281521276, REGON (statistical number): 276282770, entered in the Central Register and Information on Economic Activity (CEIDG), acting within this Website under the RESTONIM brand.
- Contact with the Service Provider: the e-mail address office@restonim.com or the postal address given in point 2.
- These Terms are the terms referred to in Article 8 of the Polish Act of 18 July 2002 on the provision of electronic services. The Service Provider makes them available free of charge on the Website before the contract is concluded, in a way that allows them to be obtained, reproduced and recorded.
- RESTONIM is software that the Service Provider is preparing for release and the brand under which the Website operates. The company planned for the future development of RESTONIM is not the Service Provider, a contracting party or a personal data controller.
- The activity carried out within the Website and the Waiting list is not the provision of legal assistance, and using them does not create a client relationship with an attorney-at-law (radca prawny).
§ 2. Definitions
- User — a person using the Website or the Waiting list.
- Waiting list — a free service provided electronically, consisting of recording the User’s e-mail address and sending to that address messages related to the sign-up and commercial information, including offers, relating to the RESTONIM software, in particular information about its availability.
- Commercial consent — the User’s consent to receiving from the Service Provider, at the e-mail address provided, commercial information, including offers, relating exclusively to the RESTONIM software, given in the sign-up form (Article 398 of the Polish Act of 12 July 2024 — Electronic Communications Law).
- Confirmation of the sign-up — clicking the “I confirm my sign-up” button on the page opened from the link sent by e-mail.
§ 3. Type and scope of services
- The Service Provider provides the following services free of charge: a) making the content of the Website available, including information about the RESTONIM software; b) the Waiting list; c) remembering the chosen language of the Website in the browser, if the User uses the language selector.
- Signing up for the Waiting list is not a purchase, an order, a licence agreement or a binding reservation. It does not activate a trial, does not create an account or a licence and does not oblige either party to conclude any future contract concerning RESTONIM.
- No sales are conducted, no payments are accepted, no licences are activated and no software is made available for download on the Website. The content of the Website, including the price list, is for information purposes only and does not constitute an offer within the meaning of the Polish Civil Code.
- Commercial information sent within the Waiting list relates exclusively to the RESTONIM software. The Service Provider does not send information about other parties’ products or services and does not share e-mail addresses with other parties for marketing purposes.
§ 4. Technical requirements
- Using the Website requires a device with internet access and an up-to-date web browser supporting encrypted connections (HTTPS). Using the Waiting list also requires an active e-mail address.
- Signing up for the Waiting list works without JavaScript; without it, some form messages may not be shown.
- The Website does not use cookies. The use of browser storage is described in the Privacy policy.
§ 5. Signing up for the Waiting list and conclusion of the contract
- To sign up for the Waiting list, the User enters an e-mail address, ticks the acceptance of the Terms together with the confirmation of being at least 18 years old and the Commercial consent and submits the form. Both boxes are required and are not pre-ticked. The Commercial consent is required because the Waiting list consists solely of sending information relating to RESTONIM. Accepting the Terms is not marketing consent.
- After the form is submitted, the Service Provider sends a message with a confirmation link to the address provided. The link is valid for 48 hours.
- The contract for keeping the User on the Waiting list is concluded upon Confirmation of the sign-up. The Service Provider confirms the sign-up by e-mail.
- A sign-up that is not confirmed in time expires. Unconfirmed sign-ups are deleted no later than 72 hours after the form is submitted.
- The User may provide only their own e-mail address or an address they are entitled to use.
- Submitting again an address that is already on the Waiting list does not create a new sign-up. For security reasons, the Service Provider limits the number of confirmation messages sent to the same address and the number of sign-ups from the same network address.
- Only persons who are at least 18 years old may use the Waiting list. The Service Provider does not collect dates of birth; the User confirms being at least 18 years old in the sign-up form. The Service Provider deletes the sign-up of a person under 18 without delay once it learns of it.
§ 6. Obligations of the User
- The User is prohibited from providing unlawful content.
- In particular, it is prohibited to sign up other people’s e-mail addresses without authorisation, to make sign-ups by automated means and to take actions that disrupt the operation of the Website or circumvent its security measures.
§ 7. Duration and termination of the contract
- The contract for keeping the User on the Waiting list is concluded for a fixed term of 24 months from the Confirmation of the sign-up; when it ends, the contract expires and the address is removed from the Waiting list. The User may sign up again.
- The User may at any time, without giving reasons and at no cost, terminate the contract and withdraw the Commercial consent — by clicking the “Unsubscribe” link in any message or by writing to office@restonim.com. The Service Provider then removes the address from the Waiting list without delay.
- Withdrawing the Commercial consent terminates the contract, because without this consent the Service Provider cannot provide the Waiting-list service. Withdrawal of consent does not affect the lawfulness of processing carried out before its withdrawal.
- A User who is a consumer may withdraw from the contract within 14 days of its conclusion, without giving reasons and at no cost (Article 27 of the Polish Consumer Rights Act of 30 May 2014). To meet the deadline it is sufficient to unsubscribe from the Waiting list or to send a statement to office@restonim.com before it expires; the model withdrawal form in Annex 2 to that Act may be used but is not mandatory. The Service Provider confirms the unsubscription or the receipt of the statement by e-mail without delay, except for a one-click unsubscription in the e-mail program.
- The availability of RESTONIM does not end the Waiting list or the contract. After RESTONIM becomes available, the Service Provider may continue to send commercial information covered by the Commercial consent until the contract is terminated or expires in accordance with point 1.
- The Service Provider may terminate the contract with immediate effect if the User breaches § 6 and, in other cases, with 14 days’ notice, in particular if work on RESTONIM is discontinued. The Service Provider informs the User of the termination by e-mail.
§ 8. Complaints
- Complaints concerning the Website or the Waiting list can be sent to the e-mail address office@restonim.com or to the Service Provider’s postal address.
- A complaint should state the e-mail address it concerns and describe the problem.
- The Service Provider handles a complaint within 14 days of receiving it and sends the reply to the e-mail address or the address given in the complaint.
§ 9. Specific risks of using electronic services
- Using electronically provided services involves the risks typical of the internet, in particular attempts to obtain data by deception (phishing), malicious software and unsolicited messages.
- In Waiting-list messages the Service Provider never asks for passwords or payment details and never asks you to install software. The messages are sent from office@restonim.com, and the links in them lead only to the restonim.com domain.
- Users are advised to use up-to-date software and to check the sender address and the addresses of links.
§ 10. Personal data
- The controller of personal data processed in connection with the operation of the Website and the running of the Waiting list is the Service Provider. Details are given in the Privacy policy.
- Users’ personal data are not transferred to the planned company merely because it is established. Any change of data controller requires a separate legal assessment and informing the Users and, where the law so requires, also their consent.
§ 11. Governing law and dispute resolution
- Contracts concluded under these Terms are governed by Polish law. The choice of law does not deprive a consumer of the protection afforded by provisions that cannot be derogated from by agreement under the law of the country of the consumer’s habitual residence.
- A consumer may use out-of-court complaint and redress procedures, in particular the assistance of a district (municipal) consumer ombudsman or consumer organisations, and proceedings before a permanent consumer arbitration court at the provincial inspector of the Trade Inspection. Information about these options is available on the website of the Polish Office of Competition and Consumer Protection (UOKiK).
- Disputes are resolved by the courts having jurisdiction under the general rules.
§ 12. Changes to the Terms
- The Service Provider may change these Terms for important reasons: a change in the law, a change in how the Website or the Waiting list works, or a change in the scope of services, including in connection with RESTONIM being made available.
- The Service Provider informs the Users on the Waiting list of a change by e-mail at least 14 days before it takes effect. A User who does not accept the change may terminate the contract as set out in § 7 point 2.
- A change to the Terms does not extend the scope of the Commercial consent given and does not change the personal data controller.
§ 13. Final provisions
- These Terms apply from the day they are made available on the Website in the version stated at the beginning of this document.
- These Terms are available in Polish, English and German. The Polish version is binding.
